Halle Berry faces a temporary setback in her custody battle with former partner, Olivier Martinez. The Catwoman star has been denied custody of her 13-year-old son, Maceo Robert Martinez.
According to a recent TMZ report, the judge granted Olivier Martinez custody of their son. Speaking with the publication, Patrick Baghdaserians, Martinez’s lawyer, confirmed the news. Baghdaserians said the French actor will now have primary physical custody of Maceo. Previously, the former partners had joint custody of Maceo, but the court has now denied that arrangement.
TMZ also reported that the judge rejected Halle Berry’s lawyers’ plea to restore dual custody. Additionally, the ruling also restricts Berry from visiting her son overnight. However, the judge rejected Martinez’s request to restrict the X-Men star’s custody during the holidays. Following the judge’s decision, Baghdaserians described it as a “huge victory.” In contrast, representatives for the Berry held the tiebreaker, saying she still had 50-50 custody.
Why Halle Berry and Olivier Martinez’s fight over their son isn’t over yet
The ongoing custody battle between Halle Berry and Olivier Martinez centering on Maceo is far from over. The judge’s recent ruling suggests only a temporary arrangement. Because neither parent has secured full, permanent custody yet, future legal proceedings are expected. The court will hear the case again in November 2026.
In the latest hearing, Martinez accused Berry of choking their 13-year-old during a September 26, 2026 incident. Berry, however, has denied the allegations. The court has taken Maceo’s verdict personally, and the parents were asked to leave the courtroom.
Another matter made matters worse for Halle Berry. The 60-year-old’s Instagram handle was allegedly hacked last week. Afterward, a post from her account read, “If kids disrespect their mom, the root cause often traces back to their relationship with the father.” That statement from her official social media account created a complicated situation.
