Halle Berry has faced a significant setback in her ongoing custody dispute with ex-husband Olivier Martinez. A judge has issued a ruling that changes the custody arrangements for their 13-year-old son, Maceo. The decision also brings new restrictions on Berry’s visits with him.
Halle Berry faces new custody restrictions in battle with Olivier Martinez
According to TMZ, Martinez’s attorney, Patrick Baghdaserians, confirmed that his client received primary physical custody of Maceo. The former couple previously shared joint custody of their son. Berry’s legal team had reportedly sought to restore a 50/50 arrangement.
The judge rejected that request, but the custody dispute is not necessarily over. According to Baghdaserians, the court plans to reconsider custody issues in November. That means the current arrangement could face further review.
One major restriction concerns Berry’s overnight visits with Maceo. The judge reportedly ruled that the actress can no longer have overnight visits with their son. However, Martinez’s request to restrict Berry’s custody time during holidays was denied.
Martinez’s attorney described the custody decision as a “huge victory.” He said the judge considered evidence about both parents’ approaches to raising Maceo. Berry’s representative also clarified that she retains joint legal custody.
Berry reportedly holds tie-breaking authority if the former couple cannot agree on decisions. This means the ruling distinguishes physical custody from legal decision-making. The two parents therefore continue to share legal custody despite the change in living arrangements.
The dispute has included serious allegations that both sides have contested. Martinez previously alleged that Berry choked Maceo, but she denied the allegation.
The proceedings also involved a closed hearing where Maceo gave testimony. Berry had reportedly tried to prevent her son from testifying, arguing that Martinez had coached him. The court ultimately allowed the testimony to proceed behind closed doors.
Earlier in the week, a controversial Instagram post attributed to Berry also became part of the dispute. Sources close to the actress claimed that her account had been hacked.
However, there was one outcome in Berry’s favor: the judge dissolved the domestic violence restraining order. The custody ruling remains a major development for the former couple, with the court expected to reconsider the arrangements in November.
