Halle Berry saw a temporary restraining order dissolved in her custody dispute with ex-husband Olivier Martinez, but the ruling left him with primary physical custody of their 13-year-old son, Maceo.
The decision followed a contentious nine-day hearing over the couple’s parenting arrangements. They retained joint legal custody, but Berry lost overnight parenting time.
Halle Berry’s restraining order is dissolved, but ex Olivier Martinez retains primary custody of their son, per report
Page Six reported that Los Angeles Superior Court Judge Shelley Kaufman lifted Berry’s temporary restrictions Thursday and rejected Martinez’s request for a domestic violence restraining order. Berry’s attorney, Marina Beck, said, “We are extremely pleased that the Court has dissolved the TRO.” She added that Berry remained focused on her family’s “well-being and best interests.” A source characterized the decision as “a huge win for Halle.”
However, TMZ reported that Martinez retained primary physical custody. His lawyer, Patrick Baghdaserians, said the judge rejected Berry’s request to restore equal parenting time. The judge also barred Berry from overnight visits, although Martinez did not secure holiday restrictions. Berry’s representative said she retained joint legal custody and had the tiebreaker in the event of disagreements.
The ruling followed nine days of proceedings. Maceo, his therapist, and a school official testified behind closed doors. Berry, Martinez, her daughter Nahla Aubry and fiancé Van Hunt also testified. Martinez reportedly left one of the proceedings after becoming upset.
Martinez, 60, accused Berry, also 60, of choking Maceo during a September 26 altercation. Berry has denied the allegation. She accused Martinez of obstructing their son’s education and therapy. She sought sole legal custody and proposed alternating weeks.
Aubry, 18, defended her mother in a court declaration. She said she felt “shocked” by the allegations and had never seen Berry act aggressively toward Maceo. Earlier, a seemingly hacked Instagram post from Berry’s account claimed that children’s disrespect toward mothers often stemmed from their fathers. Kaufman rejected Martinez’s request to reopen the evidence over that post.
The former couple married in July 2013, separated two years later, became legally single in December 2016, and finalized their divorce in August 2023.
