Halle Berry sought to restore her previous custody arrangement with ex-husband Olivier Martinez as their legal dispute over their 12-year-old son, Maceo, continued.
The actress requested a return to their earlier parenting arrangement despite a temporary restraining order that recently limited her time with Maceo. Martinez opposed her request and accused Berry of physically abusing their son. Berry did not directly address those allegations in her filing.

Berry asked the court to restore the custody agreement from August 2023, which gave both parents equal custody of Maceo.
She also requested the return of her authority to resolve parenting disagreements when the former couple could not reach a decision. Additionally, Berry wanted the court to require Martinez to participate in their previously ordered therapy sessions.
As per PEOPLE, in her filing, Berry accused Martinez of involving Maceo in disagreements between the parents. She claimed their son sometimes returned from visits with his father feeling angry toward her.
“When Maceo would come home from his custodial time with Olivier, he would be angry and combative,” Berry alleged.
She claimed Maceo sometimes repeated details from discussions that she and Martinez had held privately. Berry also accused Martinez of interfering with decisions concerning their son’s education, therapy and extracurricular activities.
The actress further alleged that Martinez had resisted interventions she believed would benefit Maceo. She claimed this affected his school progress and behavior.
Berry also accused Martinez of refusing to accept her relationship with her fiancé, Van Hunt. She alleged that his objections prevented Maceo from participating in family therapy with her and Hunt.
However, Martinez presented a different account in his court response.
He asked the court to reject Berry’s request and accused her of physically abusing Maceo during a September 26 incident. Martinez alleged that Berry attacked their son while he played a virtual reality game.
He also sought sole custody and protective orders against Berry.
On October 1, a Los Angeles County judge granted Martinez a temporary restraining order protecting him and Maceo. The court restricted Berry’s visitation hours but allowed continued contact between mother and son.
The judge declined Martinez’s request for sobriety monitoring, citing insufficient information.
The former couple finalized their divorce in 2023 after nearly eight years of legal proceedings. They later agreed to co-parenting therapy in May 2024 but later disputed attendance at those sessions.
Berry and Martinez continued to present conflicting allegations as the custody dispute proceeded.
