Demi Lovato’s ex Max Ehrich is facing another legal issue in Florida. Police arrested the actor after a 911 hang-up reportedly led officers to find him near some bushes at a shopping center. The incident happened on August 25, although details surfaced weeks later. Ehrich now faces a nitrous oxide possession charge following the unusual encounter.

According to an arrest affidavit obtained by TMZ, Ehrich called 911 but disconnected after the call was connected. Officers responded to the location anyway. They then found Ehrich in the bushes beside a plastic bag, according to the report. The bag allegedly contained a large nitrous oxide canister labeled “Max Cream Charger.”
Police wrote that Ehrich appeared “dazed” and had trouble maintaining his balance. However, officers did not say they directly saw him inhale or use nitrous oxide. The affidavit reportedly noted that a nozzle was attached to the canister, which officers believed indicated that someone had previously used it.
Ehrich allegedly told police that he wanted medication from his parents’ home but felt uncomfortable going there. He also told officers he did not intend to harm himself. Police later spoke with his parents before arresting him. Ehrich then complained of feeling unwell, so officers took him to a hospital before transporting him to jail.
Us Weekly also reported that Ehrich posted bond and left custody shortly afterward. The actor previously dated Demi Lovato in 2020. The pair became engaged that July before ending their relationship in September.
Ehrich also faced legal trouble in 2025. Authorities arrested him in connection with an alleged domestic violence incident involving a family member. His latest arrest, however, centers on the August 25 911 hang-up and the nitrous oxide authorities say they found nearby.
The circumstances described in the affidavit do not establish that Ehrich used nitrous oxide. At this stage, the case concerns the possession charge outlined in the arrest paperwork.
