Kim Zolciak’s Son Gets Major Court Update After Hearing Is Called Off

Kim Zolciak’s 15-year-old son Kroy KJ Biermann Jr. is facing a new development in his sexual assault case. The teenager was due in court Tuesday, but his preliminary hearing was canceled after a Georgia grand jury indicted him on seven felony charges. He remains in custody as his case moves forward.

KJ’s attorney, Jason Sheffield, confirmed to Page Six that the Sept. 3 state indictment is now the “controlling action” in the case. As a result, the judge who was scheduled to oversee Tuesday’s preliminary hearing will no longer handle it.

“Because the State indicted my client, the judge who would have presided over the preliminary hearing today has been divested of that authority,” Sheffield said.

The state intends to try KJ as an adult, according to Sheffield. He plans to ask for the case to be transferred to juvenile court. He said, “I’m going to file motion for the case to be transferred to juvenile court and for him to be tried as a juvenile.”

KJ has been held at Atlanta’s Metro Regional Youth Detention Center since his Aug. 17 arrest. His bond hearing is now scheduled for Sept. 11, according to Fulton County court records.

“We are expecting to enter not guilty pleas to all charges at the plea and arraignment hearing on October 14,” Sheffield said outside court.

KJ was indicted on seven felony charges. These include aggravated child molestation, aggravated sodomy and aggravated sexual battery. He also faces three counts of sexual battery against a child under 16 and one count of false imprisonment. The charges stem from an alleged April 23 encounter with a female classmate. The incident reportedly took place at a Life Time fitness center in Alpharetta, Georgia.

Sheffield has maintained that KJ is “100% innocent.” He previously asked for the teenager’s release, pointing to his academic record, football achievements, scholarship offers and ties to his family and community.

The RHOA star, Zolciak, has also fiercely defended her son, previously calling the allegations “reckless and deeply troubling”. She also said that she remains “confident that the facts and evidence will establish the truth.”
