Kimora Lee Simmons is clearing up confusion after a divorce filing sparked headlines about custody of her youngest son. A new report says the filing contained a clerical error and never reflected the fashion mogul’s actual wishes for 11-year-old Wolfe.
The correction changes one of the biggest talking points in the divorce. It does not change the couple’s ongoing financial dispute.

According to TMZ, a source with direct knowledge said Simmons has no intention of giving estranged husband Tim Leissner primary legal or physical custody of Wolfe. The source explained that Simmons has maintained primary custody since the couple separated in 2020.
The outlet reported that Simmons’ response to Leissner’s divorce petition mistakenly checked the box requesting primary custody for him. The source attributed the mistake to a clerical error rather than a change in Simmons’ position.
The correction also comes with important context. Leissner remains in federal prison for his role in the multibillion-dollar 1MDB corruption scandal. He also previously admitted to using fraudulent divorce documents to marry Simmons while he remained legally married to his first wife, Judy Chan.
Before the clarification, the filing surprised many because it appeared to go further than Leissner’s own request. His original divorce petition sought joint legal and physical custody of Wolfe rather than primary custody.
The rest of Simmons’ filing remains unchanged. According to the report, she asked the court to block Leissner from receiving spousal support. She also requested that he pay spousal support to her and cover her attorney’s fees throughout the divorce.
The former couple married in 2014 and legally separated in 2022 after roughly 12 years together. Leissner filed for divorce in April after signing the paperwork shortly before reporting to a Pennsylvania federal prison. His petition also requested spousal support and asked the court to prevent Simmons from collecting alimony.
Last December, Simmons described herself as the “primary parent” during an interview with People. Along with Wolfe, she shares daughters Ming and Aoki with ex-husband Russell Simmons and son Kenzo with actor Djimon Hounsou. She has also spoken publicly about helping raise a non-biological son.
The custody correction may have resolved one headline, but the former spouses still face several unresolved issues before they can officially end their marriage.
