An Eva Marcille HOA dispute is now in court, and the Bravo alum says she’s not giving in. Her attorney says the RHOA star won’t lose her home over a few minor violations.
Eva Marcille’s husband/attorney is challenging the association’s fines and enforcement tactics
TMZ obtained a lawsuit filed by the homeowners association in Eva’s Atlanta neighborhood. She owns a $1.8 million home with five bedrooms and five bathrooms. The HOA says she got repeated notices about breaking the community’s maintenance rules. The lawsuit claims she failed to treat weeds or mow the lawn. It also alleges she left inoperable cars in the driveway and let a vehicle’s registration lapse. Additionally, she allegedly kept trash cans in plain sight.
The suit says Eva had plenty of time to fix the problems and didn’t. The HOA is asking for more than $22,000 in past assessments and fines, plus a court order making her clean up and comply right away. Eva hadn’t responded when TMZ first reported the suit. Her attorney has since spoken up.
That attorney is Michael T. Sterling, a trial lawyer who divorced Eva in 2023 and got back together with her in 2025. He says she won’t lose her home over weeds or a parked vehicle, and he plans to fight the HOA “at every turn.”
Sterling says an HOA shouldn’t use fines, fees and liens to scare homeowners over small violations. He pointed to the Georgia Property Owners’ Bill of Rights Act. According to him, the law shows that the state wants to protect homeowners from overreach and abusive enforcement. He plans to use every legal option to defend Eva’s rights.
He also said the legal dispute is about more than one homeowner. Eva, he said, won’t be bullied or threatened out of her home, and the HOA picked the wrong homeowner to push around.
