Republican Oklahoma Secretary of State Busted at McDonald’s

Benjamin Lepak was arrested in Edmond, Oklahoma, on suspicion of public intoxication after police responded to a 911 call outside a McDonald’s.

The Oklahoma Secretary of State was seen in police bodycam footage holding a bag of food as officers questioned him about whether he had been drinking.

Police bodycam footage shows Lepak standing outside a McDonald’s while clutching a brown bag of food when officers arrived. According to the New York Post, police responded to a 911 call from someone who said Lepak appeared to be drunk.

“I just wanted to call and see if you guys can come check someone that’s out here, he’s been out here for like a while now, like he’s not causing a scene or anything but he does seem drunk,” said the 911 caller to the dispatchers.

“I’m just gonna be honest, people are calling because they’re worried about you being intoxicated,” one officer said in the bodycam footage. Lepak then tried to defend himself but soon began rambling.

Lepak slurred, “I haven’t.” “I don’t want to.. I want to eat my McDonald’s,” he said before rambling that his kids had started a new school.

Police also became aware of Lepak’s previous arrest in 2021. He was charged with actual physical control of a vehicle while intoxicated and transporting an open container of beer. He later pleaded guilty and was sentenced to community service and probation.

After initially denying that he had been drinking, Lepak admitted that he had a beer before stopping to get McDonald’s. The officer then told him, “You’re under arrest for public intoxication,” and added, “You’re lucky it’s not for a DUI [driving under the influence]. You understand?”

Police proceeded to handcuff Lepak as he protested. Oklahoma Attorney General Gentner Drummond also issued a statement calling for Lepak to be fired, according to local reporting.

Lepak was appointed Secretary of State in January 2026 and formally assumed the role on April 28 after Senate approval. His term ends on Jan. 11, 2027.
