The lawsuit challenges Kevin O’Leary’s public claims tying Utah data center opponents to China
Kevin O’Leary appeared on Fox News as a guest on May 24 to address the ongoing controversy surrounding his Utah data center project. He claimed that Gabrielle Finlayson, Josh Kantor, and Taylor Knuth from Alliance for a Better Utah, a group fighting against data center construction in Utah, were funded by China. Soon after the comments, the Shark Tank star faced backlash from the group and online users.
Now, O’Leary and the network are facing a data center lawsuit over his comments. The alleged lawsuit filing, according to Variety, states that Finlayson and Kantor “suffered devastating reputational harm, significant economic losses, severe emotional distress, and ongoing threats to their physical safety.”
The filing read, “Fox was instrumental in O’Leary’s defamatory smear campaign, putting him on air to attack Plaintiffs five times in three weeks.” They alleged that the news channel repeatedly invited O’Leary, allowing him to make accusations.
Earlier, the news channel publicly apologized for the error, stating, “ We are likewise aware of no evidence that they are funded by, acting in the direction of, or in coordination with Chinese interests in opposing Mr. O’Leary’s project. Fox News Media also apologizes for the error.”
The network has now issued the statement in response to the data center lawsuit. Their statement read, “Fox News Media publicly corrected the record on every program where on-air guest Kevin O’Leary’s comments were made, all of which was extensively publicized. We will vigorously defend against this lawsuit.” However, the businessman has not made any public comment on the Kevin O’Leary lawsuit.
