Alberto Del Rio Charged By Grand Jury With Multi-Count Indictment, Includes Aggravated Kidnapping

Mike Johnson of PWInsider is reporting that Alberto Del Rio (real name Jose Rodriguez Chucuan) was indicted by a grand jury in San Antonio, TX on five charges that include four counts of sexual assault and one kidnapping that occurred back on May 3. An official press release from The Bexar County Sheriff’s Department was issued this morning.

Del Rio was arrested back in May of this year when his victim went to the local authorities after claiming that Del Rio physically assaulted her after she allegedly would not admit to infidelity. According to the report Del Rio slapped her  across the head several times before trying to force her to dance in a dress for him. After she wouldn’t, Del Rio allegedly told her to not start crying or he’d drop her son off somewhere in the middle of the road.

The following is from the May 10 FOX 29 news report out of San Antonio in which the details get more graphic:

“Police said Rodriguez Chucuan then tied the woman’s hands with boxing straps, put a sock in her mouth and sexually assaulted her for several hours, using various objects. According to investigators, he also punched her in the back during the assault, causing visible injuries. The victim told detectives she does not remember much after he placed his hand around her throat.”

At the time, Del Rio was released on $50,000 bond. According to Texas law, Del Rio could face a minimum of two years in prison if convicted of one of the four counts of sexual assault. Under second degree felony, he could face a fine of up to  $10,000 as well as potential incarceration.

Concerning the kidnapping charge, if punished in the first degree under Texas law, Del Rio could see a minimum of five years and a maximum of a life sentence in addition to a fine up to $10,000. However, if he’s able to prove that he released the victim voluntarily, Del Rio could be convicted for aggravated kidnapping that ranges from a 2-20 year prison sentence and face up to a $10,000 fine.

An official court date has not yet been set and the plan is for Del Rio to be arraigned today.
