Former Special Counsel Jack Smith fired back at Republican senators in a heated exchange that could shape the future of presidential accountability. Smith defended his investigations into Donald Trump during a tense Senate Judiciary Committee hearing, rejecting accusations of political bias.
Senators pressed Jack Smith over subpoenas involving lawmakers, donors and other records
Former Special Counsel Jack Smith defended his investigations into President Donald Trump during a Senate Judiciary Committee hearing on Monday, according to Al Jazeera. Smith told senators his probes followed Justice Department policy and relied on evidence, not political motivation.
Republican lawmakers sharply challenged Smith over his investigative methods. Committee Chairman Chuck Grassley accused Smith’s team of using subpoenas to target the broader Republican Party. Senators questioned why his office obtained phone records linked to members of Congress without notifying them.
Smith maintained his team had a duty to pursue all relevant evidence. He explained the phone records helped confirm that Trump and allies contacted lawmakers during efforts to delay the 2020 election certification. Smith also noted his office consulted the Justice Department’s Public Integrity Section before obtaining those records.
Texas Senator Ted Cruz, whose records were among those sought, pressed Smith on the lack of notification. Smith responded that prosecutors feared evidence destruction or interference if subpoenas were disclosed. The records revealed call times and durations but not content. Legal experts have noted no law prohibited seeking such records during the investigation.
Smith also accused the Trump administration of retaliating against prosecutors and agents from his team. He said former team members were fired for performing their duties. In March, three former FBI agents filed a class-action lawsuit alleging illegal termination as part of a broader retribution effort.
Smith framed the hearing as part of a larger challenge to Justice Department independence. He stated the rule of law faces unprecedented threats. Smith added he would not be silenced by continued prosecution threats from the president. Trump has denied all charges and called the investigations a political witch-hunt orchestrated by former President Joe Biden.
