A Supreme Court ruling against Donald Trump’s bid to end birthright citizenship triggered a backlash from Megyn Kelly. She particularly criticized conservative justices appointed by the president. The 6-3 ruling reaffirmed that children born on American soil hold citizenship rights under the 14th Amendment, regardless of their parents’ immigration status.

The conservative commentator criticized Justices Amy Coney Barrett and Brett Kavanaugh, both Trump appointees. They joined Chief Justice John Roberts and the court’s three liberal members to form the majority. Dissenting were Clarence Thomas, Neil Gorsuch, and Samuel Alito.
Megyn Kelly singled out the conservative justices who backed the decision, labeling them as lacking courage. “The 14th [Amendment] was never intended to allow any non-citizen to confer citizenship on her child (& thereby skip the line) by delivering the baby here,” she wrote on X. “This Court majority, especially the squish conservatives, are all too afraid of being called ‘racist’ to find accordingly.”
Her criticism did not stop there. Kelly shared a report from Fox News reporter Bill Melugin, who claimed he “saw a lot of women who were very obviously in late-term pregnancies who were crossing the river illegally, likely knowing that giving birth on U.S. soil would immediately give their child U.S. citizenship.” She also backed a proposal from former federal prosecutor William Shipley. The proposal called for visa revocations for pregnant women and mandatory reporting of positive pregnancy tests by healthcare providers.
When Utah Senator Mike Lee suggested that a constitutional amendment was the only viable path forward, Kelly dismissed the idea outright. She noted that the requirement of approval from 38 states made such an effort impossible. She added that the court itself should have shown the necessary resolve.
Mike Lee has said he plans to introduce the proposal as a constitutional amendment in Congress.
