Eminem Challenges RHOP Stars’ ‘Reasonably Shady’ Trademark in New Motion

Eminem has filed a motion seeking an early ruling in his trademark dispute, challenging RHOP stars Gizelle Bryant and Robyn Dixon. The dispute focuses on whether Bryant and Dixon had genuine plans to use the trademark when they filed the application.

Eminem filed a new motion with the Trademark Trial and Appeal Board to reject the trademark application for cosmetics and candles. He wants the board to determine whether Bryant and Dixon genuinely intended to use the trademark when they applied.

The filing read, “The undisputed record in this proceeding compels a single conclusion: Applicants lacked a bona fide intent to use the mark REASONABLY SHADY on any good in International Class 3 or International Class 4 at the time they filed the Application. The record is barren—not merely thin—of any evidence of such intent. Opposer is entitled to summary judgment as a matter of law.”

Eminem’s lawyer argued that the discovery process had produced no business records showing their plan for cosmetic products and candles.

The motion also cited Dixon’s July 2023 testimony. She said in testimony, “No current plans, but that’s not to say that we would never. But at the moment, we don’t have anything.”

Later in the September declaration, Dixon clarified that her July 2023 testimony, she described the situation at that time rather than her intentions.

The legal declaration by Dixon read, “I did not include candles, lip gloss, eye shadow, or makeup in the application simply to prevent others from obtaining trademark rights or to reserve the REASONABLY SHADY name without an intention to use it. They were included because we intended to expand the existing REASONABLY SHADY brand into those product categories.”

The Trademark Trial and Appeal Board allowed Eminem’s intent on August 17 and reopened discovery through September.
