Emily Kathleen Mortimer was born in Finsbury Park, London, England on December 1, 1971 to parents Sir John Mortimer and his second wife, Penelope. Her father was a famous writer and barrister, made most famous for authoring the Rumpole of the Bailey book series. Growing up, Emily attended the prestigious St. Paul's Girls' School in West London, where she first began acting. By the time she was ready to attend college, she enrolled at Lincoln College, Oxford University where she studied both English Literature and Russian. She also spent two terms studying acting at the Moscow Arts Theater Drama School.

It was while in a student production at Oxford that Emily was initially discovered by a TV producer who went on to cast her on the mini-series "The Glass Virgin." By 1996, she landed her first feature film role in "The Ghost and the Darkness" alongside Val Kilmer. Since then, she has gone on to star in dozens of high profile film and television projects including "Shutter Island," "Our idiot Brother," "Hugo," and the critically acclaimed HBO series "The Newsroom." As of January 2013, it was announced that she had co-created and would star in the comedy series "Doll & Em" for Sky Living.

It was while filming the 2000 film "Love's Labour's Lost" that Emily met and married husband Alessandro Nivola. The two have gone on to welcome two children into the world by the names of Samuel and May Nivola. Emily currently holds dual citizenship in both England and the U.S. to avoid paying an inheritance tax should anything happen to her husband.
